Gateman-Milloy Inc. and its related companies (“Gateman-Milloy”) maintain an internal recruiting function. From time to time, Gateman-Milloy may supplement this function with the assistance of temporary staffing agencies, placement services, and professional recruiters (collectively, “Agencies”). Agencies are directed not to contact Gateman-Milloy employees directly to present candidates. Only Gateman-Milloy’s Human Resources team is authorized to present candidates to hiring managers.
To protect the interests of all parties, Gateman-Milloy does not accept unsolicited resumes from any source other than directly from a candidate. Any unsolicited resumes sent to Gateman-Milloy, including those sent to a Gateman-Milloy mailing address, fax number, email address, directly to Gateman-Milloy employees, or to Gateman-Milloy’s resume database, will be considered the property of Gateman-Milloy. Gateman-Milloy will not pay a fee for any placement resulting from the receipt of an unsolicited resume. Any candidate submitted by an Agency on an unsolicited basis will be deemed submitted without any obligation on the part of Gateman-Milloy to pay a fee or other charge.
Agencies must obtain advance written approval from Gateman-Milloy’s Human Resources Manager before submitting resumes, and may do so only in connection with a specific job opening and pursuant to a valid, fully executed service agreement. Gateman-Milloy will not pay a fee to any Agency that does not have such an agreement in place.
Agency agreements are valid only if they are in writing and signed by Gateman-Milloy’s Human Resources Manager or an officer of Gateman-Milloy. No other Gateman-Milloy employee is authorized to bind Gateman-Milloy to any agreement regarding the placement of candidates by Agencies. Gateman-Milloy specifically rejects and denies any liability under any agreement purporting to be accepted based on negative consent, negotiation with a candidate, performance, or any means other than the written signature of Gateman-Milloy’s Human Resources Manager or an officer of Gateman-Milloy.
